Understanding Your Rights Under the Women's Health and Cancer Rights Act (WHCRA)
The Women's Health and Cancer Rights Act (WHCRA) is a federal law that provides important protections for individuals who have undergone a mastectomy due to breast cancer. Here’s what you need to know:
Coverage & Care: Under WHCRA, if your health plan covers mastectomies, it must also cover certain reconstructive surgeries and services. This includes reconstruction of the breast removed by mastectomy, surgery on the other breast to achieve a symmetrical appearance, prostheses, and treatment for physical complications at all stages of mastectomy, including lymphedema.
Your Rights: You have the right to this coverage regardless of the state you live in, as this is a federal requirement. Health plans cannot deny you coverage based on pre-existing conditions or your past health history.
